Protect Your Rights

Step 1 of 8 · Our Process

The days after an accident are when injury claims are most often damaged. Insurance adjusters call quickly, evidence disappears, and deadlines start running. Our first job is to step in between you and the insurance companies so you can focus on getting better.

What we do right away

  • Take over all insurance communication. Once we represent you, adjusters must speak with us, not you. You do not have to give a recorded statement to the other driver’s insurer.
  • Preserve evidence. We request the police or CHP report, identify witnesses, and ask for video from nearby businesses and traffic cameras before it is recorded over.
  • Document the scene and damage. Photos, vehicle damage, repair estimates and, when needed, an accident reconstruction expert.
  • Identify every insurance policy. The at-fault driver’s liability coverage, your own uninsured/underinsured motorist (UM/UIM) and medical payments coverage, and any rideshare or commercial policy.

California deadlines you should know

  • Two years to file a lawsuit for personal injury in most cases (Code of Civil Procedure § 335.1).
  • Six months to file a written claim if a city, county, state agency or other public entity is involved, for example a crash with a city bus or a dangerous road condition (Government Code § 911.2).
  • Ten days to report the accident to the DMV on form SR-1 if anyone was injured or property damage exceeds $1,000 (Vehicle Code § 16000).

Missing one of these deadlines can end a claim no matter how strong it is, which is why it pays to speak with a lawyer early.

What you can do

  • Get medical care right away, even if you feel “fine.” Some injuries appear days later.
  • Take photos of the vehicles, the scene and your injuries, and keep the names and numbers of any witnesses.
  • Do not admit fault, sign anything or accept a quick settlement check from an insurance company.
  • Stay off social media about the accident. Insurers look for posts and photos to use against you.
  • Keep every bill, receipt and pay stub related to the accident in one place.
