How We Handle Your Personal Injury Case

At the Law Office of Sean Keshishyan in Glendale, most personal injury cases follow the same eight steps. Many settle before a lawsuit is ever filed. Here is what to expect from your first call to the final result, and how we protect you at every stage.

No Fee Unless We Recover

We work on a contingency fee basis. You pay no attorney fees unless we recover compensation for you.

We Advance Case Costs

Our firm pays litigation costs as your case moves forward; they are reimbursed from the recovery.

Steps 1 – 4

Before a Lawsuit

Most cases are resolved during these first four steps, often without ever going to court.

Step 1 of 8

Insurance companies often take advantage of accident victims during the vulnerable time following a traumatic incident. Our legal team immediately takes over all communication with the insurance companies to protect your rights, and we preserve evidence and document the facts of the case while they are still fresh.

Step 2 of 8

We connect you with leading medical professionals in your area to diagnose and treat your injuries. If you cannot afford treatment, we can arrange care on a medical lien basis: you pay nothing up front, and your medical bills are paid from the settlement at the end of your case.

Step 3 of 8

All documentation supporting your claim is organized into a “demand package” that tells the story of your case to the at-fault insurance company. The insurer responds with an acceptance, a counteroffer or a rejection. We keep you informed throughout, and you always make the final decision.

Step 4 of 8

The majority of our cases settle at this stage, before a lawsuit is filed. You sign a settlement release in exchange for the agreed compensation, and our firm negotiates with your medical providers to lower your bills and maximize the money in your pocket.

Steps 5 – 8

If a Lawsuit Is Needed

When an insurance company refuses to pay what your case is worth, we are ready to take it all the way.

Step 5 of 8

If the insurance company’s offer is unreasonable, we file a lawsuit on your behalf. This elevates your claim and often leads to a higher settlement. Our firm pays the costs of litigating your case, so you don’t pay out of pocket; these costs are reimbursed from the settlement.

Step 6 of 8

Although jury trials are rare, we prepare every case as though it will go before a jury, gathering additional evidence and retaining expert witnesses. A deposition is your opportunity to tell your story under oath, and we question the at-fault party under oath as well.

Step 7 of 8

Before trial, your case will likely go before a neutral mediator who hears both sides and recommends a settlement. Many cases resolve here. Arbitration is similar and is required when we are collecting from your own insurance company rather than the at-fault driver’s insurer.

Step 8 of 8

This is the final step in getting you the compensation you deserve. Our trial lawyers present your case to a jury of your peers, who decide the amount of compensation that is fair after hearing all the evidence.
